Alimony

In California, alimony is referred to as spousal support. The Court can order one party to pay spousal support to the other spouse either while the divorce case is pending, or in the final judgment. If the Court orders spousal support while the case is pending, it is called either “temporary spousal support” or “temporary partner support.” The Court will consider the following factors in setting spousal support:

  1. The length of marriage or domestic partnership;
  2. Each parties’ needs;
  3. Each parties’ earnings and earning capacity (what they can pay);
  4. Child care issues;
  5. Age and health of both parties;
  6. Debts and property; and,
  7. Whether one spouse or partner helped the other with school, training or a career;
